TO THE DEFENDANT: Tenants of 643 Private Road 1242, Texarkana, AR and Alexis Joy McGilberry
On January 25, 2013, a complaint was filed against you by America HomeKey in the Circuit Court of Miller County, Arkansas, for the purpose of foreclosing on real property in the principal amount of $84,239.00, together with accrued interest, attorneys’ fees, costs and late charges, if any. The above-mentioned real property is described as follows:
All that certain tract or parcel of land being a part of the SW 1/4 of the NW 1/4 of Section 29, Township 15 South, Range 27 West, Miller County, Arkansas, and being a part of the same tract as described in Warranty Deed from William Chesley Vanderbilt, et al to Shawn Lynn Russell dated April 8, 2004, Recorded in Volume 2004, Page 1798 of the Deed Records of Miller County, Arkansas and being more particularly described as follows: Commencing at a found 3 inch iron pipe at the SW corner of said Section 29, Township 15 South, Range 27 West, Miller County, Arkansas; thence North 00 deg. 47 min. 12 sec. East, with the West boundary line of the SW 1/4 of said Section 29, 2645.29 feet to a point; thence South 88 deg. 40 min. 01 sec. East, with the South boundary line of the NW 1/4 of said Section 29, 765.08 feet to a set 5/8 inch rebar for corner and being the point of beginning for the herein described tract of land; thence South 88 deg. 40 min. 01 sec. East, with the South boundary line of the NW 1/4 of said Section 29, 221.91 feet to a set 5/8 inch rebar for corner; thence North 00 deg. 47 min. 12 sec. East, passing at 590.56 feet a set 5/8 inch rebar on the South right-of-way line of a 50 foot wide Access Easement and continuing a total distance of 615.56 feet to the centerline of a 50 foot wide Access Easement; thence North 89 deg. 30 min. 56 sec. West, with the centerline of the above described 50 foot wide Access Easement, 221.90 feet to a point for corner; thence South 00 deg. 47 min. 12 sec. West, passing at 25.00 feet a set 5/8 inch rebar and continuing a total distance of 612.27 feet to the point of beginning, containing 3.1274 acres of land, more or less.
Together with the following described Access Easment:
All that certain tract or parcel of land being a part of the South 1/2 of the NW 1/4 and a part of the SW 1/4 of the NE 1/4, all in Section 29, Township 15 South, Range 27 West, Miller County, Arkansas and being a part of the same tract as described in Warranty Deed from William Chesley Vanderbilt, et al to Shawn Lynn Russell dated April 8, 2004, Recorded in Volume 2004, Page 1798 of the Deed Records of Miller County, Arkansas and being a part of a 6.67 acre tract as described in Warranty Deed from William E. McTier and wife, Mary Ellen McTier to Shawn Russell dated October 19. 2000. Recorded in Volume 407, Page 67 of the Deed Records of Miller County, Arkansas and being more particularly described as follows: Commencing at a found 3 inch iron pipe at the Southwest corner of said Section 29, Township 15 South, Range 27 West, Miller County, Arkansas; thence North 00 deg. 47 min. 12 sec. East, with the West boundary line of the SW 1/4 of said Section 29, 2645.29 feet to a point; thence North 00 deg. 47 min. 12 sec. East, with the West boundary line of the NW 1/4 of said Section 29, 625.94 feet to a point; thence South 89 deg. 30 min. 56 sec. East, 5.92 feet to a point for corner and being the point of beginning for the herein described Access Easement; thence South 89 deg. 30 min. 56 sec. East, 1326.31 feet to a point for corner; thence South 89 deg. 28 min. 59 sec. East, 1290.05 feet to a point for corner; thence South 01 deg. 39 min. 53 sec. East, 223.90 feet to a point for corner; thence North 87 deg. 39 min. 53 sec. East, 1368.82 feet to a point for corner on the West right-of-way line of County Road No. 70; thence South 02 deg. 35 min. 11 sec. West, with the West right-of-way line of County Road No. 70, 40.15 feet to a point for corner; thence South 87 deg. 39 min. 53 sec. West, 1418.42 feet to a point for corner; thence North 01 deg. 50 min. 03 sec. East, 226.50 feet to a point for corner; thence North 89 deg. 28 min. 59 sec. West, 1214.68 feet to a point for corner; thence North 89 deg. 30 min. 56 sec. West, 1350.59 feet to a point for corner; thence North 00 deg. 37 min. 04 sec. East, 50.00 feet to the point of beginning, containing 4.5175 acres of land, more or less.
You are hereby warned to appear and defend by filing an answer or other responsive pleading with this Court within thirty (30) days from the date of the first publication of this Warning Order.
Your failure to file a written answer within thirty (30) days may result in a default judgment being entered against you for the relief sought in the complaint.
