PUBLIC NOTICE OF DRAFT NODISCHARGE PERMIT
PERMIT NO. 4839-WR-1 AND AFIN NO. 46-00344

This is to give notice that the Permits Branch of the Water Division of the Arkansas Department of Environmental Quality (ADEQ), 5301 Northshore Drive Little Rock, Arkansas 72118-5317 at telephone number 501-682-0648, proposes a draft permit-modification for an application that was received on October 17, 2007 under the Arkansas Water and Air Pollution Control Act.
The applicant is Terra Renewal Services, Inc. of P.O. Box 3036, Russellville, Arkansas 72801. The two proposed land-application sites are located in all Quarters of Section 2, Township 14 South Range 27 West, in Miller County, Arkansas. The two sites have the following coordinates and areas:
Site BV-17 Latitude: 33° 34 04 North, Longitude: 93° 51 22 West, Area: 250 acres
Site BV-18: Latitude: 33° 33 51 North, Longitude: 93° 51 35 West, Area: 155 acres
This permit modification is for the operation and maintenance of a beneficial land-application system of various industrial wastes previously permitted are post processing food wastes residuals, dissolved air flotation (DAF) skimming, poultry processing wastes, grease trap waste, feed and grain mill waste, hatchery waste, post processing animal and pet food waste, food processing pretreatment waste and residuals.
The land-application sites are located adjacent to the Gillspie Ditch in Stream Segment 1B. Stream Segment 1B is in the Red River Basin which is in the list of impaired streams of the State of Arkansas.
This is a modified draft permit and only the modified portion of the permit can be reopened for comment.
Under the Standard Industrial Classification (SIC) code 4853 or the North American Industry Classification System (NAICS) code 56299, the application activities are for the operation of the land-application of various on the sites described above.
ADEQs contact person for submitting written comments, requesting information regarding the draft permit, or obtaining a copy of the permit and the Statement of Basis is Henry C. Insua, at the above address and telephone number. For those with internet access, a copy of the proposed draft permit may be found on the ADEQs website at www.adeq.state.ar.us.
The last day of the comment period is 30 days after the above date. The permit will become effective approximately two weeks after the close of the comment period unless comments are received and/or a public hearing is requested prior to the close of the comment period requiring a delay of the effective date. Comments and public hearing procedures may be found at APCEC Regulation No. 8. All persons, including the permittee, who wish to comment on ADEQs draft decision to issue the permit must submit written comments to ADEQ, along with their name and mailing address. After the public comment period, and public hearing, if one is held, ADEQ will issue a final permitting decision. A public hearing will be held when ADEQ finds a significant degree of public interest. ADEQ will notify the applicant and each person who has submitted written comments or requested notice of the final permitting decision. Any interested person who has submitted comments may appeal a final decision by ADEQ in accordance with the APCE Regulation No. 8 (Administrative Procedures, as amended).
