Texas-side alcohol election can be placed on November ballot
The Texarkana, Texas, City Council can move forward with a resolution to put off-premise sales of beer and wine on the November ballot, a judge ruled Monday morning.
Visiting District Judge Webb Biard of Lamar County, Texas, inked his name on an order denying a request for a temporary restraining order filed last week on behalf of two Texarkana, Ark., liquor store owners. The suit complained that the city accepted the petition on a Saturday and alleged signatures weren’t properly verified.
Setting the election for Nov. 4 is on the Texas-side Council agenda when they meet tonight.
Texarkana lawyer Jeff Lewis argued that the suit is an attempt to delay a vote on the issue until May, when voter turnout is lower and presented documentation that the signatures have been authenticated as required under Texas law.
