Jury deliberations start in Joe Cool’ killings

One minute, 18 seconds.

That’s all it took Kirby Archer, 36, and Guillermo Zarabozo, 20, to seize control of the Joe Cool and execute the charter boat’s four-member crew, a federal prosecutor told jurors Tuesday in closing arguments.

To act so quickly, Archer opened fire on the captain and his wife on the boat’s fly deck while Zarabozo killed the two other crewmen down below, prosecutor Karen Gilbert said.

As for Zarabozo’s explanation that he was in the bathroom when Archer killed all four victims, Gilbert called it “unbelievable.”

“It’s all made up,” she said. “None of that ever happened.”

Zarabozo, a former security guard who lived with his mother in Hialeah, is charged in Miami federal court with first-degree murder, hijacking, kidnapping and other crimes.

Jurors began deliberating Tuesday after roughly five days of testimony. Zarabozo took the stand Monday. Archer, who pleaded guilty in July to first-degree murder and conspiracy, did not testify.

Defense attorney Michael Caruso told jurors Zarabozo aspired to be a police officer and had no motive to kill anyone or flee the country, unlike Archer.

The former Army officer was on the run from Arkansas law enforcement after stealing $92,000 from the Wal-Mart where he worked.

Caruso said Archer needed an accomplice to steal a boat and duped Zarabozo into boarding the Joe Cool by lying about a security job for him in Bimini.

Prosecutors contend the killings on the Joe Cool took place in one minute and 18 seconds because the on-board navigation system showed the boat lurched off course for that brief period before turning sharply south for Cuba.

Gilbert urged jurors not to feel sorry for Zarabozo because of his youth or because Archer might have manipulated him.

“This is a quadruple homicide case,” she said, “with four dead people.”
