Couple challenging Arkansas rule on foster children

How old is too old?

Too old to adopt a child under the age of 1?

Well, In Arkansas at least, if you are over 40, the state Department of Human Services thinks you are indeed too old.

A DHS policy prohibits those over 40 from adopting a child in foster care if the child is under 1 year old.

For children ages 1 and above, prospective parents can be up to 55 years old.
