Judge rules lawsuit not a class action

Plaintiffs seek damages from railroad in connection with 2005 derailment, explosion

A lawsuit seeking damages from Union Pacific Railroad in connection with a derailment and explosion in 2005 in Texarkana, Ark., will not proceed as a class action, a federal judge has ruled.

Federal Judge Harry Barnes of the Western District of Arkansas ruled the lawsuit doesn’t meet the requirements necessary to be made a class action.

Instead, the suit will deal only with the specific complaints of the named plaintiffs, Gloria Bradford and the business she owns, Books Etc., Ned Burnett, Samuel Alexander and Stella Smith. The trial is scheduled for June 2.
