The lawyer representing a man accused of burglary and sexual indecency is asking the court to approve a mental evaluation for the defendant.

“Your honor, I’d like to request a trial date a little while in the future,” said Danny Cook, the Texarkana attorney representing Derrick Kyle Garton. “I’ve had some new information come to light just today. I’m going to be requesting a mental evaluation.”

Fifth District Judge Ralph Burgess scheduled Garton to return to court in about two weeks for another pretrial hearing.
