‘Inmate dumping’ case to remain in Texas court

A lawsuit alleging a man was beaten by guards at the Miller County jail and then “dumped” at a Texas-side hospital will remain in Texas federal court.

On July 2, U.S. District Judge David Folsom of the Eastern District of Texas denied a motion to dismiss the lawsuit for lack of jurisdiction filed on behalf of the defendants.

In Texarkana, federal courts for both states are housed on the upper floors of the downtown post office. Lawyers representing Miller County argued the case should be moved across the hall from Folsom’s court to a federal courtroom in Arkansas.
