Tyler-based Brookshire Grocery Co. will join about 50 other retailers suing Nestlé, Hershey’s, Mars and Cadbury in a multi-district litigation that alleges the candy giants conspired to fix prices.

Brookshire’s suit is being moved from a federal court in Marshall, Texas, and joined with others from around the country that will be managed from a federal court in Pennsylvania.

Brookshire’s is asking for damages that equal three times the amount of its calculated losses, court costs, attorney fees and interest on the money at “the highest legal rate.”
