Man gets 10 years for drug offense

One of multiple defendants accused of methamphetamine trafficking was sentenced to 10 years in prison Monday by a federal judge in Texarkana.

Gerald Clinton Davis, 47, appeared for sentencing with Texarkana lawyer Jeff Harrelson before U.S. District Judge Robert Schroeder III. Davis pleaded guilty to conspiracy to distribute meth in June. According to a factual basis on file in the case, Davis and others conspired to distribute methamphetamine in the Mount Pleasant area, which had been purchased in bulk from a supplier in the Dallas area.

Davis, who is listed on the case docket in the Texarkana Division of the Eastern District of Texas as Defendant Eight, was sentenced to a 120-month term Monday. One of Davis' co-defendants, Jason Wayne McLemore, 40, was sentenced to 151 months in federal prison by Schroeder at a hearing in October 2017.

McLemore is listed in court records as Defendant Five. The name of the first defendant and the indictment itself remain under seal. Those records typically remain under seal until a named defendant has been arrested and appeared before a judge.

Defendant Two listed in the case is Daniel Enrique Montes-Munoz, 37, who previously pleaded guilty to conspiracy to distribute methamphetamine in the case. He is scheduled for sentencing Nov. 20.

Timothy Franklin Harper, 31, has pleaded guilty to conspiracy to distribute methamphetamine and is scheduled for sentencing Nov. 20 before Schroeder as well. Harper is listed in court records as Defendant Four.

Collin Hayden Garrett, 24, appeared in court for arraignment Monday morning before U.S. Magistrate Judge Barry Bryant. Garrett is listed as Defendant Six. He entered a plea of not guilty Monday to conspiracy to distribute methamphetamine. Records show Garrett was recently arrested in Louisiana.

As the defendants listed as Two, Four, Five, Six and Eight in court records have been arrested and appeared in the case, it appears several defendants remain charged but have not appeared in court. Federal guidelines typically include a 10-year minimum punishment for conspiracy to distribute methamphetamine.

All of the defendants whose names have been unsealed in the case remain in federal custody.
