Jury acquits felon of firearms possession

A Cass County, Texas, woman was acquitted by a jury this week of being a convicted felon illegally in possession of a firearm.

Texarkana lawyer John Delk represented Elizabeth Nicole Price in a trial Thursday in Linden, Texas. Price was accused of possessing two guns May 4, 2014, in violation of state law which makes it a crime for a person with a felony conviction to possess a firearm. According to a probable cause affidavit, Price grabbed the guns during a confrontation with several male members of her husband's family who wanted to remove property from her house that she and her husband didn't agree they should take.

Price was convicted before the date of the alleged offense in Cass County of multiple state jail felony forgeries in a different Texas county to which she pleaded guilty on the same day, Delk said. A felony conviction, even for a non-violent offense, carries with it an automatic prohibition from possession of a firearm.

After hearing testimony in the case, the jury acquitted Price of the charge.

"I'm grateful for the jury's service and I'm grateful for the opportunity to protect the rights of the accused at trial," Delk said. "My client looks forward to moving forward with her life."
