NWA Media ANDY SHUPE Dan Snowden helps his grandson Noah Gaffney, 3, all of Fayetteville, to fly a kite Sunday, May 26, 2013, in Gulley Park in Fayetteville. Snowden said he and Noah had come the day before as well to fly the kite in the strong winds of late morning.

The owner of Williams Hauling and Towing instructed the company's safety director, a 65-year-old man who was undergoing chemotherapy at the time, to call Michael Gibson, 54, back to the office to clean out his truck Feb. 2, 2014, according to a probable cause affidavit used to create the following account.

After the safety director informed Gibson that his services were no longer needed, Gibson allegedly returned to the business' office and confronted him as he got out of his car. Gibson allegedly waited until the ailing safety director turned his head before hitting him with his fist. Gibson allegedly continued to punch the senior safety director in the head and face after he was on the ground.

Gibson was indicted earlier this month for injury to an elderly individual. The third-degree felony is punishable by two to 10 years in a Texas prison. Gibson's case has been assigned to 202nd District Judge Leon Pesek, Jr.
