Testimony begins today in trial of man charged with sexual misconduct

NEW BOSTON, Texas-A jury of six men and six women was chosen Tuesday to decide the fate of a Hooks, Texas, man accused of sexual misconduct with a child.

Daniel Mooneyham, 33, faces two to 20 years if convicted of indecency with a child by sexual contact involving a girl who was 9 at the time of the alleged offense Oct. 2, 2014.

Mooneyham is also charged with two counts of aggravated sexual assault of a child involving a different girl but that case is not being presented to the jury selected Tuesday. A date for trial on those cases, each of which includes a punishment range of five to 99 years or life in prison, has not been scheduled.

Opening arguments and testimony from the first of the state's witnesses is expected to begin this morning at the Bowie County Courthouse in New Boston, Texas, in the 202nd district court over which District Judge John Tidwell presides. The trial is expected to last at least two days.

Mooneyham is represented by Texarkana lawyer Kristian Young. First Assistant District Attorney Mike Shepherd and Assistant District Attorney Katie Carter are representing the state.

Mooneyham is currently in custody.
