MAUD, Texas -- A man arrested for allegedly killing his brother-in-law will be in court Tuesday for a pretrial, according to Bowie County court records.

Billy John Scott, 51, is charged with murder. He is being held in the Bowie County jail on a $100,000 bond, according to Bowie County jail records.

Scott's case will be tried in Bowie County 202nd district court with Judge John Tidwell presiding.

The fatal shooting in Maud happened in June.

At 7:54 p.m. on June 21, Bowie County deputies were dispatched to a shooting in the 500 block of Birch Street. Capt. David Grable found Larry Dewayne Kirby lying in the roadway and being attended to by the person who had called 911.

Kirby, 39, of Maud, was bleeding badly, so a tourniquet was placed on his leg to improve his chances of survival. Kirby was able to tell the person who called 911 that Scott had shot him, according to the sheriff's office. However, Kirby died of his injuries after EMS arrived.

Arrangements were made for Scott to surrender, and he was booked into the Bi-State jail.

Scott will be defended by public defender Bart Craytor, according to court records.
