State justices suspend nonpayment evictions

LITTLE ROCK - The Arkansas Supreme Court this week issued an order suspending residential evictions for nonpayment of rent until July 25.

The order notes that new eviction complaints for nonpayment of rent or failure to vacate must show how the residence is not a covered dwelling under the federal Coronavirus Aid, Relief, and Economic Security Act (CARES). The additional requirement remains in effect until July 25.

Associate Supreme Court Justice Shawn Womack wrote a dissenting opinion in which Associate Justice Rhonda Wood joined which argues that the additional requirement violates the state's constitution.

The Texas Supreme Court issued an order April 6 suspending eviction proceedings until April 30. An order issued April 27 extends the suspension until May 15. Evictions for reasons such as danger to other occupants or criminal activity may proceed.
