Three men arrested at Atlanta residence | One failed to register as a sex offender, police say

ATLANTA, Texas-Three men have been arrested in Atlanta after police responded to a house where a fugitive had allegedly been hiding.

The Atlanta Police Department received information Wednesday that a fugitive with an active felony arrest warrant for failure to comply with sex offender's duty to register for life was inside a residence located in the 100 block of Red Bluff in Atlanta. Officers believe the fugitive had been hiding from Cass County sheriff's deputies to avoid apprehension, according to information on the APD's Facebook page.

Officers responded to the residence and located several subjects living, including the wanted fugitive. Officers arrested three of the four people found inside the residence.

Anthony Lee Upchurch, 41, of Queen City, Texas, was arrested on charges of failure to comply with sex offender's duty to register and a city ordinance violation (sex offender living within a child safe zone), according to the Facebook post.

Additional criminal charges are pending against Upchurch through the Atlanta Police Department.

Charles Richard Morse, 28, of Atlanta, Texas, was arrested on a misdemeanor warrant possession of drug paraphernalia.

Shon Cole Fomby, 25, of Bivins, Texas, was arrested on a misdemeanor warrant for walking on the wrong side of the road and a misdemeanor warrant for failure to appear, according to the post.
