Man accused of shooting his child's mother now accused of sexually assaulting her

TEXARKANA, Texas - A man who was free on bond for allegedly shooting the mother of his child in April was arrested Monday for allegedly strangling and sexually assaulting the same woman.

Jimmy Lee Mitchell, 33, allegedly told the woman that he can have sex with her whenever he wishes because they have a child together, according to a probable cause affidavit. The woman reported to a Texarkana, Texas, Police Department detective that Mitchell came to her apartment at 2 a.m. Monday morning.

Mitchell allegedly used a roll of duct tape he brought with him to bind the woman's ankles before choking and sexually assaulting her. Mitchell allegedly stayed at the woman's apartment for several hours, refusing to leave.

A long scratch and bruising on the woman's neck and lines on the woman's ankles from the tape were allegedly visible to investigators when they met with her Monday morning. While the woman was undergoing an exam at a local hospital, investigators went to the woman's apartment with a key she provided.

"On a TV stand in the bedroom was a roll of duct tape. Beside the roll was tape that had been removed from the roll. The tape was wrapped into a circle that was consistent with being wrapped around a person's ankles," the affidavit states.

Mitchell was charged with child endangerment and aggravated assault in April for allegedly shooting the woman while their 1-year-old child was in the back seat, according to a probable cause affidavit. Mitchell was allegedly angry because she visited a male friend.

At the time of his release from custody on a $75,000 bond in connection with the alleged shooting, Mitchell was ordered to have no contact with the woman. According to a motion to revoke Mitchell's bond, a misdemeanor warrant for Mitchell's arrest was issued August 12 in connection with an alleged assault of the woman Aug. 7.

Mitchell was arrested on the misdemeanor warrant Aug. 17 and released Aug. 19 after posting a $3,000 bond, court records show. Mitchell will remain in the Bowie County jail where he is currently being held if his bond is revoked.

Mitchell was arrested Aug. 23 on the bond surrender and the new charges of felony assault family violence and sexual assault. He is scheduled to appear before 202nd District Judge John Tidwell for a status hearing next month.
