IN OUR VIEW/The Court and Roe; Will justices overturn controversial abortion precedent?

On Wednesday, the U.S. Supreme Court heard arguments in a Mississippi case that could see a reversal of the landmark Roe v. Wade decision and leave the decision whether to allow legal abortion in the hands of the states.

It's a moment those of both sides of the debate have been waiting for. Those who are pro-choice expect the court to uphold the Roe v. Wade precedent. However, pro-life activists see this as their best chance to finally make abortion illegal in many states.

The Mississippi's law in question bans most abortions after 15 weeks. The court has previously held that states do not have a compelling interest in protecting a fetus until it reaches viability -- currently around 24 week. The question before the court is whether to hold to that standard. Of course, there is always the chance the court could craft a narrow decision that somehow manages to uphold the law while keeping Roe v. Wade. However, many legal experts see viability as key to the precedent and don't see how one can exist without the other.
